Service.
Crosswave Health, Inc. (Crosswave Health) owns and operates the website www.findlocaltreatment.com (the Site). The Site, together with all content, forums, information sharing functions and collaborative services (including information and services related to identifying, locating, evaluating, selecting and contacting healthcare Providers) that are provided at the Site, are collectively referred to as the Service.
The following policy explains how Crosswave Health collects, uses and disseminates information obtained from or about you as a user of the Service. Capitalized terms used herein without definition will have the same meanings as defined in the Terms of Service applicable to the Service.
Information Collected.
When you visit the Site or otherwise access the Service, web servers collect general information about your visit (such as, for example, traffic data like time, date and the address of the website from which you entered the Site), which is stored and used by Crosswave Health. Crosswave Health also collects more specific information about you and your use of the Service (such as, for example, demographic data, profile data and frequency or duration of use). Collecting such data (collectively, Traffic Data) may entail the use of software programs, web beacons, pixel tags, cookies, IP addresses or other numeric codes used to identify a computer. Traffic Data (including your IP address) may be associated with the applicable User.
Providers may visit the Site, but are obligated to enter into Provider Contracts with Crosswave Health to receive the full benefit of the Service. Crosswave Health may obtain and store Personal Data pursuant to execution of the Provider Contracts.
Individuals may provide certain information about themselves to receive the full benefit of the Service: city or zip code; gender; age group; substance of choice; and type of insurance.
Whenever you interact with the Service, a variety of technologies are employed to automatically or passively collect Service Data. The term Service Data means all data and information that you provide during use of the Service (including messaging related to Providers, Healthcare Services and appointments), and all other data and information about you that are otherwise discerned or collected by Crosswave Health based on your access and use of the Service. Service Data includes, but is not limited to: Personal Data; browser or device type; operating system; time of day; identification of Site page views; use of particular Service features (such as, for example, searching for or contacting Providers); and geographic location. For clarity, Service Data includes data that Crosswave Health records regarding each visit to the Site, which permits it to replay, search and analyze each User's actual and complete experience using the Site. At no time will Crosswave Health access, collect or store any of the personal contacts or photographs or any other information stored on your device without your permission.
Children.
Crosswave Health will not collect personally identifiable information from any person who is actually known to us to be under the age of 13. If we become aware that a person under 13 has provided personally identifiable information, Crosswave Health will take steps to remove such information and terminate that individual's access and use of the Service.
Use of Information.
Except as set forth below, at no time will any of your Personal Data be shared with any third party by Crosswave Health.
Crosswave Health uses Traffic Data to help diagnose problems with its web servers, to administer the Service and to analyze user trends and behaviors. Crosswave Health will share Traffic Data with certain third parties for the purposes of technical and customer support.
Crosswave Health collects, stores, processes and analyzes Service Data and produces Analytics. The term Analytics means user profiles and statistics, metrics, abstractions, rules, models and other analyses that are based on or derived from the Service, Service Data and/or your use of the Service. We may use third party tools (e.g., Google Analytics) to derive Analytics.
Crosswave Health will use your Service Data and exploit Analytics in the manner and for the purposes described in these Terms of Service, including without limitation: to use Service Data to communicate with you (including, by email); to include, copy, disclose, distribute, transmit and display Service Data in communications that have been properly initiated via the Service, but only to the extent and in the manner that comply with your then current preferences; to access, record, collect, copy, store, process, analyze and use Service Data to provide the Service in accordance with your preferences (which could include using Personal Data in messaging with other Users); to develop, improve, extend and test the Service (and underlying technology platforms); to use Analytics to customize Content for you; and to design, develop, distribute and use Analytics (including in connection with marketing and promoting Crosswave Health and the Service). Except in connection with providing the Service, Crosswave Health will not use Service Data in a manner that discloses the identity of any Individual. Crosswave Health reserves the right to retain and use Service Data after you cease using the Service.
As an example, if you are an Individual and use the Service to contact a Provider, then Crosswave Health will share relevant Personal Data with that Provider, which may include your name, address, contact information, date of birth, health insurance information and (if provided by you) personal health information.
You may opt-out from receiving certain messages in the manner set forth below.
Call Logging
Some treatment providers have call logging setup for their profile. This means they have a unique number on their profile that, when called, forwards to their regular phone number. Crosswave Health logs metadata about these forwarded calls that includes the following anonymous information: Call duration, time and date of call, call status (answered, no-answer), city of caller, and state of caller. This information helps Crosswave Health and treatment providers improve their services, and it helps communities understand where help is needed most. Call contents are NEVER recorded, and Crosswave Health does not store the phone number of the caller. All calls are anonymous.
IP Addresses, Cookies and Web Beacons.
IP Address.Crosswave Health uses your IP address to help diagnose problems with its web servers and administer the Service. Your IP address is used to help identify you and to gather demographic information. For example, we may derive your general geographic location (city, state or metropolitan region) based on your IP address. IP addresses are also used to provide an audit trail regarding use of the Service.
Cookies.Cookies are small files that are stored on your computer, smartphone or other device by your web browser. Cookies in and of themselves do not personally identify users, although they do identify a user's computer.
At this time, the only cookies we use are "session cookies" and we do not permit third parties to drop their cookies on your device. As the name suggests, session cookies help us provide the Service only during the current session. Session cookies are transient, existing only in temporary memory while currently using the Service. Session cookies are deleted when you close the browser.
On most web browsers, you will find a "help" section on the toolbar. Please refer to this section for information on how to receive notification when you are receiving a new cookie and how to refuse some or all cookies, or to delete existing cookies from your device. We recommend that you leave cookies turned on because they allow you to take advantage of some of the Service's features.
Web Beacons.A web beacon (which is also known as a "clear gif" or "pixel tag") is an electronic file that usually consists of a single-pixel image. It can be embedded in a web page or in an email to transmit information, which could include Personal Data. For example, it could allow an email sender to determine whether a user has opened a particular email.
At this time, Crosswave Health does not use web beacons.
Behavioral (Targeted) Advertising.
Online behavioral (or targeted) advertising refers to a broad set of activities companies engage in to collect information about your online activity (like website pages you visit) and use it to show you ads or content they believe to be more relevant to you. To accomplish this, companies use a variety of tools to collect information, typically including cookies, web beacons and tracking pixels.
At this time, Crosswave Health does not engage in behavioral or targeted advertising.
Data Integrity.
Crosswave Health processes Personal Data only for the purposes for which it was collected and in accordance with this Privacy Policy or any applicable Service-specific privacy notice. We periodically review our data collection, storage and processing practices to ensure that we only collect, store and process the Personal Data needed to provide or improve our Service. We take reasonable steps to ensure that the Personal Data we process is accurate, complete, and current, but we depend on you to update or correct your Personal Data whenever necessary.
Do Not Track Policy.
Your browser may offer you a "Do Not Track" option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities, over time and across different websites. Do Not Track signals are set on a browser-by-browser basis, so you must set them on every browser you use if you do not wish to be tracked.
At this time, Crosswave Health does not track your online activities outside of the Service. Therefore, setting or releasing your Do Not Track signal will not affect how the Service operates.
For clarity, this is just our Do Not Track Policy. Crosswave Health cannot and does not make any promises about how third parties react when you set Do Not Track signals on your browser. In addition, the Do Not Track signal does not impact the use of information collected prior to such request.
Sharing of Personal Data.
Currently, Crosswave Health or providers will not share Personal Data with any third party for purposes that are not related to the Service. Crosswave Health will share your Personal Data with its third party service providers, solely for use in connection with providing the Service on Crosswave Health's behalf. In addition, Crosswave Health may also disclose Personal Data if a) reasonably necessary for Crosswave Health (or its service providers) to operate and provide the Service, including processing your queries, responses and other messages and making disclosures to other Users in accordance with your preferences, (b) otherwise permitted under the Privacy Policy or elsewhere in the Terms of Service, (c) Crosswave Health reasonably believes that such action is necessary to conform or comply with any legal, regulatory, law enforcement or similar requirement or investigation, to protect or defend the rights or property of Crosswave Health or any third party or to enforce the Terms of Service or (d) otherwise authorized by you.
As an example, if you are an Individual and use the Service to contact a Provider, then Crosswave Health will share relevant Personal Data with that Provider, which may include your name, address, contact information, date of birth, health insurance information and (if provided by you) personal health information.
HIPAA.
Crosswave Health is not legally obligated to comply with the Health Insurance Portability and Accountability Act of 1996, including the Privacy Rule, Security Rule and other implementing regulations (collectively, HIPAA), or the Health Information Technology for Economic and Clinical Health Act (Title XIII, Subtitle D), including its implementing regulations (HITECH).
California Residents.
Crosswave Health does not meet the threshold conditions and is not considered a “business” and therefore, is not subject to the requirements of the California Consumer Privacy Act. Under California Civil Code Section 1798.83 (the “Shine the Light” law), because Crosswave Health, Inc. does not share your personal information with third parties for the third party’s direct marketing purpose, Crosswave Health has no further obligations under the Shine the Light law.
Nevada Residents.
Nevada law allows Nevada residents to opt-out of the sale of certain types of personal information. Subject to a number of exceptions, Nevada law defines “sale” to mean the exchange of certain types of personal information for monetary consideration to a person for the person to license or sell the information to additional persons. We do not currently sell personal information as defined in the Nevada law. However, if you are a Nevada resident, you still may submit a verified request to opt-out of sales and we will record your instructions and incorporate them in the future if our policy changes. Utah Residents.
We do not disclose your Personal Data to any third party for such third party’s direct marketing purposes.
Business Transfers.
Crosswave Health may transfer Traffic Data, Service Data (including Personal Data) and Analytics to any successor to all or substantially all of its business or assets that concerns the Service. In the event of any such transfer, the successor will have all of the rights and be subject to all of the obligations of this Privacy Policy, including, without limitation, the right to modify or replace this Privacy Policy, as provided herein.
Security.
Information collected by Crosswave Health is stored in operating environments that are secured using commercially available tools and procedures, and which are not made generally available to the public. Unfortunately, no data transmission over the Internet and/or wireless networks can be guaranteed to be 100% secure. As a result, Crosswave Health cannot unequivocally guarantee the security of any information you provide, and you do so at your own risk. Once Crosswave Health receives your information, it will make reasonable efforts to ensure its security on Crosswave Health's systems.
Third Party Connections.
You may be able to access and/or communicate with the Service from, and you may be able to link or communicate from the Service to, applications, devices, distribution platforms and websites owned and operated by third parties. These other applications, devices, platforms and websites are not operated or controlled by Crosswave Health, and you agree that Crosswave Health is not responsible for the availability, accuracy, legality, appropriateness or any other aspect of the content or function of such applications, devices, platforms and websites. Any such connection to or from the Service does not constitute or imply any guarantee or endorsement by Crosswave Health of that application, device, platform or website or any association with its operators. Additional or different terms and conditions (including without limitation, privacy and security practices) apply when you access and use such other applications, devices, platforms and websites.
Opt-Out.
You may elect to avoid future communications from Crosswave Health by selecting the "Unsubscribe" link, which is located at the bottom of every Crosswave Health email; provided, Crosswave Health reserves the right to send you important information (such as, for example, information about changes to this Privacy Policy or the Terms of Service).
Opting-out from promotional emails becomes effective only by following the process described in the preceding paragraph.
Non-US Users.
YOU EXPRESSLY CONSENT TO THE TRANSMISSION, COLLECTION, STORAGE, PROCESSING AND USE OF THE ANALYTICS AND YOUR PERSONAL DATA IN ACCORDANCE WITH THIS PRIVACY POLICY. YOUR PERSONAL DATA MAY BE COLLECTED, STORED, PROCESSED, USED AND TRANSMITTED WITHIN, FROM, BETWEEN, AND TO THE COUNTRY WHERE IT WAS COLLECTED AND THE UNITED STATES. UNITED STATES LAWS REGARDING THE USE OF PERSONAL DATA MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY.
Updates
Crosswave Health reserves the right, at its sole discretion, to update, modify or replace this Privacy Policy, in whole or in part, at any time. Crosswave Health will use reasonable efforts to notify you of any material change in advance of the effective date of any change. Change notices may be communicated by postings at the Site, e-mail or otherwise. In any case, you should periodically check this Privacy Policy for changes. Continued access or use of the Service following any change to this Privacy Policy constitutes your acceptance of those changes. The Privacy Policy may not otherwise be amended, as they apply to you, except by a written agreement executed by you and Crosswave Health.
Information collected by the Service is subject to the Privacy Policy in effect at the time of use.
